<p>The architect of the government’s civil justice reforms has admitted the ‘jury is still out’ on a third of his proposals for clinical negligence.</p>
<p>Lord Justice Jackson said there had been little progress on three of the nine recommendations made when his report on costs was published in 2010. The proposals so far stalled include financial penalties for health authorities that fail to provide copies of medical records and a costs management scheme for clinical negligence cases.</p>
<p>Jackson also voiced doubts that regulations can be drawn up to implement the 2006 NHS Redress Act following an impasse in talks between the NHS Litigation Authority (NHSLA) and claimant groups. The act was intended as an alternative to litigation and would mean the NHSLA offers a redress package in return for a waiver of the right to sue.</p>
<p>‘Without wishing to sound unduly pessimistic,’ Jackson added, ‘I must confess to some doubt as to what will emerge from these interminable discussions.’</p>
<p>During his 12th lecture on the costs reform programme, delivered last week, Jackson said three of his recommendations had been implemented within a year of his report.</p>
<p>The time for defendants to respond to a letter of claim has increased from three months to four; the NHSLA now instructs independent experts to give evidence on liability; and defendant bodies now each nominate an officer as a point of contact for claimant solicitors.</p>
<p>Jackson noted that harmonisation of case management directions and a limited period for settlement negotiation should be enacted from April 2013.</p>
<p>In a recurring theme across his lectures, Jackson again spoke in favour of mediation as a way of settling clinical negligence cases. He said more training was needed for both solicitors and judges to change attitudes to alternative dispute resolution &#8211; there is still a ‘wall of opposition’ to mediation from solicitors and counsel in clinical cases where liability and/or causation are in dispute, he said.</p>

			<content:encoded><![CDATA[<p>The implementation at Manchester City Magistrates Court of the Standard Operating Procedure relating to applications to vacate trial dates, requires the defence solicitors to be informed of the following:-</p>
<p> 1)            Any application / response to vacate a trial date should be in writing to the court.</p>
<p> 2)            Any defence application to vacate a trial date should also be forwarded to the Crown Prosecution Service for them to respond to.</p>
<p> 3)            Any CPS application to vacate a trial date received by the defence, should be responded to in writing to the court.</p>
<p> 4)            The application / response should address the issues identified in the guidance on vacating trials, and also to prompt the Legal Adviser exercising their judicial powers or the court considering the application, to address those issues in their decision.</p>
<p> 5)            The application should also enclose availability of the defence solicitor, defendant and defence witnesses.  This is because if the trial date is vacated by the Legal Adviser exercising their judicial powers without a court hearing, he/she will then go on to relist the trial date if deemed appropriate.</p>
<p> 6)            If the application is one which is not dealt with by the Legal Adviser exercising their judicial powers, it will be listed for a hearing in court.  The defence solicitor will be notified of the hearing date which is when they should attend court in relation to the application to vacate the trial date.</p>

<p align="center"><strong><span style="text-decoration: underline;">More uncertainty hits social housing sector following Government’s defeat in Court of Appeal</span></strong></p>
<p>Yesterday’s Court of Appeal ruling thwarted the Government’s plans last autumn to bring an early end to the 43.3p Feed in Tariff (FiT) – or did it?   With the likelihood of the government appealing to the Supreme Court, more uncertainty and time lies ahead for social housing providers – and, ultimately, the UK’s most vulnerable and disadvantaged people in fuel poverty may lose out on reduced energy costs.</p>
<p>“If the government appeals to the Supreme Court” comments Lucy Worrall, partner and social housing specialist at Croftons Solicitors LLP, “by the time any final decision is reached the likelihood of any photovoltaic solar panel schemes going ahead while the 43.3p Feed in Tariff still exists is pretty slim.”</p>
<p>Continuing, Lucy said “the Court of Appeal today ruled against the government without even hearing the appeal.  The government has said it is likely to appeal directly to the Supreme Court.    If the government is defeated again (and therefore the FiT goes back to 43.3p for installation schemes from 12 December 2011 to 3 March 2012), it is likely to be so close to 3 March 2012 that there won’t be any chance of planning and installing any schemes of any significance by RPs.”</p>
<p>“As far as registered providers are concerned, it’s a gamble,” adds Lucy.  “As far as we can ascertain at this point, the only certainty is that the lower rate of 21p/16.8p is to come into effect on 3 March 2012.   Other than that, there is the risk that the government’s appeal to the Supreme Court will be upheld – in which case the FiT reduction which was due to take effect on 12 December 2011 will be in place.  On the other hand, if the government is defeated in the Supreme Court, then what little time remains from then until 3 March is probably not realistic for any scheme to go ahead unless it is already well advanced.”</p>
<p>For registered providers willing to take a risk and the 43.3p remaining for installs completed before 3 March, Lucy says “There may still be enough time for those prepared to take the gamble and install panels. For registered providers looking at a rent a roof scheme, any such scheme would realistically have to be on uncharged stock unless both the lenders and their lawyers can act very quickly to give consent. Either way, speed is of the essence!”</p>
<p>Looking beyond 3 March 2012, though, Lucy feels that registered providers have a number of other options for renewable and green energy initiatives.     “There are still a number of viable options for pv including rent a roof schemes (which many have now written off) even after the FiT is reduced.” says Lucy. “We know of providers who have devised a way to make rent a roof schemes work at no cost to RP’s but at great benefit to their tenants”.</p>
