We are now almost a year on from the introduction of the new Deprivation of Liberty Safeguards under the Mental Capacity Act and over 2 years on from the implementation of the Mental Health Act 2007, particularly the new community treatment framework. This seminar will consider some of the relevant recent legal case law that has arisen in these areas and its implication on day to day practice in the field of menatl health. Topics considered will include:
- community treatment orders under the MHA 2007
- the definition of restriction as opposed to a deprivation of liberty
- the interface between the MHA and the DoLS framework & where the line is drawn between the two system
